As of January 2024, non-use cancellation actions in Turkey have been handled by the Turkish Patent and Trademark Office (TPTO), rather than the IP Courts. DERIS has been at the forefront of non-use cancellation proceedings. Our team has successfully represented clients in some of the earliest administrative non-use actions and obtained landmark decisions under the new system.”

Obtained a landmark ruling from the General Assembly of the Supreme Court confirming that the use of an unregistered design under a third party's trademark may still constitute unfair competition, thereby extending legal protection to unregistered designs even where they are marketed under a different trademark.
